To Prepare Your Insurance Claim - Take
photographs or videotape of the damage.
- Make
temporary repairs -- save receipts for any materials that you purchase. To the
extent possible, you need to take steps to prevent further damage. Don't make
extensive permanent repairs until after the claims adjuster has been to your home
and assessed the damage.
- Call
your insurance agent or company -- report the damage.
- Save
receipts for additional living expenses -- the minimum amount available to pay
for such expenses is generally equal to 20% of the insurance on the home.
- Prepare
for the adjuster's visit -- be sure to keep copies of lists and other documents
that you submit to your insurance company and any paperwork that the insurance
company gives to you.
- Keep
a diary of all contact with your adjuster, your insurance company and your agent.
If your insurance company is not treating you fairly, deal with them politely
and confirm everything in writing. Take careful notes of who said what to you,
and always get the company to respond in writing. This may be the point at which

not speak to any representatives of the insurance company if they should try to
contact you directly, but refer them to our office. While you do have an obligation
to cooperate with them, you do not have to speak to them or allow them onto your
property unannounced and without prior permission. This they can obtain from us,
and we, or our experts, will contact you first. The insurance companies have been
known to have drillers or other testing people show up unannounced, and under
those circumstances you are free to ask them to leave and advise them to contact
your attorneys, LeValley & Napolitano, P.L.. If this should happen, let us
know at once. Speak with neighbors who may also be having a problem.
If possible, obtain any scientific reports they may have. A copy of these reports
will assist LeValley & Napolitano, P.L. in choosing the correct path in bringing
your claim to a speedy and amicable resolution.
